What Is PFOA, and Why Does It Matter?

The chemical at the center of this case is called PFOA — a synthetic substance used in factories and industrial products around the world. In 2023, the World Health Organization declared PFOA a known human carcinogen, meaning it causes cancer.

This matters legally because a chemical labeled as a carcinogen gives people harmed by it much stronger grounds to sue. The company can no longer argue the chemical is safe.

There's another issue: PFOA doesn't break down naturally. Once released into soil and water, it stays there indefinitely — which is why scientists call such chemicals "forever chemicals." The contamination doesn't fade with time.

The Damage on the Ground

This reflects a slow tightening of how the UK regulates dangerous chemicals.

Do We Know If the Chemical Actually Caused the Cancer Cases?

This is where things get complicated. Local health authorities examined whether kidney cancer rates in the area were actually higher than normal. They found no evidence that cancer cases had increased, and no proof linking kidney cancer to the chemical contamination or to living near the factory, according to Wyre Council.

But Leigh Day is proceeding with its investigation on the assumption that the connection deserves a full legal examination.

Public health researchers have published studies showing that people exposed to PFAS do seem to have higher rates of cancer, hormone problems, and weakened immune systems. But here's the distinction that will matter in court: spotting a pattern in a large population is not the same as proving that a specific chemical caused a specific person's cancer. That kind of proof — tracing a single disease back to a single exposure — is exactly where environmental contamination lawsuits run into trouble. It's difficult to prove, and many cases fail on that point alone.

Why This Moment Matters

A few things are now happening at the same time. The World Health Organization has declared PFOA a known carcinogen. Soil contamination near the plant has been confirmed. Regulators are formally considering reclassification of related chemicals. And now a law firm is launching a formal investigation.

Each of these separately might not be enough to force action. Together, they narrow the options available to both the company and the government regulators who are supposed to be watching it.

For a law firm to win a case like this, it has to prove three things: that people were exposed to the chemical, that they were harmed, and that the chemical caused the harm. Leigh Day has handled similar environmental cases before, mostly involving mines overseas, but this kind of industrial chemical pollution lawsuit is still relatively new in English courts.

The role of the Environment Agency will be crucial. If the reporting about oversight failures in October 2025 is correct, that could strengthen the legal case — residents might argue that regulators failed to do their job, in addition to arguing the company is responsible. But that's a difficult argument to win.
