Olivier Martinez seeks restraining order against Halle Berry over abuse allegation

Olivier Martinez has filed a petition for a temporary restraining order against his former wife Halle Berry, accusing her of physically abusing their 12-year-old son.
The filing was reported on 1 October 2026, according to Variety. A temporary restraining order is a short-term court order that can limit contact before a fuller hearing. Martinez names the child as Maceo, aged 12.
Martinez alleges the most recent incident took place on 26 September. He claims Berry jumped on the boy, placed her hands around his neck and choked him, as set out in the petition described by Variety. The claims are allegations contained in the filing. No court finding has been reported.
The petition goes further than a single date. Martinez contends there were other instances of abuse over the past few years, involving additional physical attacks against their son. He writes that Berry texted him to apologise after the September incident. He also states he believes Maceo may be traumatised and does not want to spend time at Berry's house.
Martinez also asks the court to order that Berry not be under the influence of alcohol or other substances during visitation with their son. That request forms part of the same petition for protection.
The filing includes allegations about language used around child support. Martinez alleges Berry told Maceo that his father is "a white bitch trying to rob a Black woman" in connection with support payments. He further alleges she asked the boy, "How do you feel about that as a Black man?" Those words are presented in the filing as Martinez's account, not as established fact.
Custody is central to the request. Martinez is asking for sole custody of Maceo, which would amend their current split custody arrangement. The move follows an earlier filing in the long dispute, when Berry sought sole legal custody of Maceo in August 2024, saying Martinez refuses to co-parent in a child-centred way, according to People.
Berry and Martinez filed for divorce in 2015 after two years of marriage. Their son's full name is Maceo-Robert, and Berry also has an 18-year-old daughter, Nahla, from a previous relationship, according to the Hindustan Times.
A separate report by People on 1 October also described Martinez's claim and his request for sole custody. Berry has not had a response reported in the verified accounts so far.
