Student activists vandalized Cornell University's Day Hall administration building overnight to protest the university's handling of gang-rape allegations. The Guardian

Damage at Day Hall

Vandals smashed a glass door at the entrance of Day Hall at approximately 3 a.m. on Oct. 5, 2026. Both the top and bottom panes of the right-hand entrance door were broken. Shards of glass covered the entryway and the floor inside.

Cornell University Police Department officers arrived at approximately 3:50 a.m. Officers at the scene declined to comment.

Cornell spokesperson Kyle Kimball said the university is investigating the vandalism and will address it under university policy and applicable law, meaning campus rules and state law if needed. Protests led by student activist groups were expected on campus on Oct. 5, 2026.

Claim of responsibility

The activists responsible sent a statement about their actions to The Cornell Daily Sun. In it, they said they acted to prevent Day Hall, the center of Cornell's administrative function, from continuing business as usual.

The manifesto described their actions as nonviolent, stating "Property damage is not violent; condoning rape is." The activists said their action was motivated in part by protest of global systems of power that allowed the alleged rape to happen.

Their demands included abolition of Interfraternity Council Greek life on campus, the council that oversees fraternities. They demanded resignation or termination of named administration officials, and replacement of Cornell's Office of Student Conduct and Community Standards with a democratic disciplinary system, one in which students would have a vote. They also demanded expulsion or revocation of degrees for all Chi Phi members involved in the alleged rape.

Lawsuit at the center

A civil lawsuit filed on Sept. 14 against Cornell University and alleged attackers alleges an October 2024 drugging and repeated rape over seven hours in the Chi Phi fraternity house. A civil lawsuit is brought by a private person seeking damages, separate from criminal charges. The Guardian

Lawyers for the plaintiff said only two of the seven Chi Phi fraternity members accused were expelled. None of the seven accused were arrested, the lawyers said, and the others were made to write essays, attend workshops or serve short suspensions. The seven accused men have denied all wrongdoing.

Tompkins County District Attorney Matthew Van Houten said his office is re-examining the case after the lawsuit presented allegations dramatically different from the woman's 2024 police statement. New York Governor Kathy Hochul appointed Attorney General Letitia James as special prosecutor, an outside attorney assigned to handle a sensitive case, to investigate the alleged gang-rape.

Cornell President Michael Kotlikoff said on Oct. 4, 2026, the school would take steps including a serious look at the role of fraternities and sororities in campus life.

Institutional and political response

Rep. Alexandria Ocasio-Cortez denounced a "culture of rape" at elite institutions referencing the Chi Phi case at an Ithaca town hall on Sept. 27. Rep. Nancy Pelosi canceled her appearance at a Cornell event the same week amid the lawsuit.

Sens. Chuck Schumer and Kirsten Gillibrand spoke out against handling of the case and demanded action. Ithaca Mayor Robert Cantelmo called the Cornell administration's response to the case "appalling."

Some New York lawmakers are urging a revamp of the state's sexual assault statutes following the alleged gang rape. Reuters New York sexual assault law distinguishes between victims who became intoxicated voluntarily, as the alleged Cornell victim appears to have done.

The broader context here is a collision of accountability systems that rarely move at the same speed, like a campus process and a court process running on separate clocks. Cornell adjudicated the allegations through an internal conduct process that produced expulsions, suspensions and educational sanctions. A criminal review did not produce arrests, and the district attorney now points to a gap between the initial police statement and the civil complaint. Students demanding abolition of Greek life and overhaul of discipline are pressing for structural change, while the governor's appointment of a special prosecutor and calls to revise state law shift the question to Albany and the courts.
