FTC Says Shkreli Traded 60 Pharma Stocks Against Lifetime Ban

On Oct. 12, 2026, the Federal Trade Commission said it and states had asked a federal court to hold Martin Shkreli in contempt for allegedly violating a lifetime ban from the pharmaceutical industry. FTC The filing asks the judge for a decision. It is not a decision itself.
Contempt in this context means disobeying a court order. The motion says Shkreli traded pharmaceutical company stocks of at least 60 companies. QZ

On Jan. 20, 2023, the government filed an earlier contempt request saying Shkreli had broken the drug-industry ban. Reuters In February 2023, Shkreli asked a U.S. judge not to hold him in civil contempt, a penalty meant to force compliance with an order. Reuters
The broader context here is how courts enforce orders after a case ends. A judge does not retry the original case. The questions are whether the ban was clear and whether the evidence shows it was broken.
In my view, the key question is whether buying and selling drug stocks counts as being in the drug industry. Think of a ban from running restaurants: does that also ban owning restaurant shares? Bans often cover running, directing or advising a company, and trading shares is a different kind of involvement. The court will read the exact wording of the order first.
Looking at what this means for enforcement, alleging trades across at least 60 companies suggests a pattern, not a one-time slip. If proven, that helps the agencies argue persistence. It also means they must link many trades, accounts and instructions to Shkreli himself.
From a compliance perspective, a court order only works if violations have consequences. A person under a lifetime, industry-wide ban must check every activity that touches that industry against the order language.
Stepping back, the 2023 filings matter for what happens next. The court will look at whether Shkreli had clear warning and a chance to change course. That history informs the decision but does not decide the 2026 request.
