Chris Brown will not go to prison. On 26 October, a London court handed the US singer a sentence of eight months, suspended for 12 months, over a bottle attack at a Mayfair nightclub in 2023. A suspended sentence means the jail term is not served unless he commits another offence during the 12 months.

The sentence follows Brown's guilty plea to affray in July at Southwark Crown Court. Affray is a public-order offence involving violence that could cause fear for other people's safety. The charge carries a maximum of three years in prison. The more serious charges, assault and attempting to cause grievous bodily harm, were dropped after he denied them.

The incident took place on 19 February 2023 at Tape, a nightclub in Mayfair, central London. Prosecutors said Brown launched an unprovoked attack on Abe Diaw, a music producer, with a tequila bottle. He hit him several times, then punched and kicked him. CCTV footage shown in court showed Brown striking Diaw four times with the bottle, twice to the head.

Omololu Akinlolu, Brown's vocal coach, was also involved. He pleaded guilty to affray and had his assault and attempted grievous bodily harm charges dropped. Akinlolu received four months in prison, also suspended for 12 months, along with a surcharge for legal costs.

Judge Tony Baumgartner addressed the bottle itself. He said the repeated use of a glass bottle was plainly dangerous and carried the risk of far more serious injury. Brown was also ordered to pay a £1,500 surcharge toward the prosecution's legal costs.

The case has run for more than three years. Brown was arrested in May 2025 by the Metropolitan Police, hours after arriving in Manchester for a concert. He spent a week in custody before being released on bail, with a £5 million security fee attached as a condition. A security fee is a sum of money put forward to guarantee that a defendant will return to court. Under his bail terms, he had to hand over his passport on arrival in each country during his world tour.

Brown arrived at the court for sentencing on 26 October, the date the judge had set when he was released after the July plea. Akinlolu was also granted bail ahead of that hearing.

For a sentencing hearing, the outcome is usually measured by what the defendant must do next. Here the main practical point is the suspension period. Both men now have 12 months in which any new offence could bring the jail terms back into play. The surcharges are a separate payment, due on top of the sentence.
