Rep. Robert Garcia, a Democrat from California, told Republicans "Lawyer up" as Democrats retook control of the U.S. Senate and were expected to retake the House in the 2026 midterm elections, The Guardian reported.

Garcia is currently the ranking member, or senior Democrat, on the House Oversight Committee, the House panel that investigates federal agencies and officials. He is expected to become its chair. A committee chair sets the panel's agenda and can seek subpoenas, which are legal orders requiring a person to provide documents or testify.

According to the same report, Garcia said that if Democrats won, he would lead investigations into Elon Musk's role in the Department of Government Efficiency, Trump family business dealings, abuses by Immigration and Customs Enforcement, and the Jeffrey Epstein scandal.

In a statement published on November 3 by House Oversight Democrats, Garcia pledged to take on corporate corruption and abuses by the Department of Homeland Security, and to pursue what he called the Trump Crime Family.

The Senate side of congressional oversight is also taking shape. Sen. Ron Wyden of Oregon signaled "subpoenas" in a one-word post on X and had previewed subpoenas if Democrats retook the Senate. Wyden is expected to return as chair of the Senate Finance Committee, while Rep. Richard Neal of Massachusetts is expected to return as chair of the House Ways and Means Committee, according to Politico.

Before midnight on November 4, Democrats had flipped competitive House seats in Kentucky, New Jersey, North Carolina, Pennsylvania and Ohio.
