NHTSA Opens Rulemaking on Vehicle Egress After Tesla Door Handle Incidents

The National Highway Traffic Safety Administration announced on July 23, 2026 that it will begin developing new requirements to ensure drivers and passengers can safely exit vehicles, following a series of incidents, including fatal ones, in which people became trapped inside cars equipped with flush, electronically operated door handles like those on Tesla vehicles (TechCrunch).
The rulemaking was first reported by Bloomberg the same day. NHTSA initiated the process in response to a petition asking the agency to open a safety defect investigation into the emergency mechanical door release design on 2022 Tesla Model 3 vehicles. The petition argued that the emergency mechanical door release on those vehicles does not comply with federal motor vehicle standards (TechCrunch; Federal Register).
NHTSA denied the petition's request for a defect investigation, concluding that the issue would be best addressed through rulemaking rather than a defect probe. The agency also stated that commencing rulemaking does not guarantee new rules will be adopted (TechCrunch; Federal Register).
The regulatory action arrives against a backdrop of accumulating safety concerns. In September 2025, NHTSA opened an investigation into Tesla's door handles after receiving nine reports from owners of 2021 Tesla Model Y vehicles who were unable to get into their cars, in some cases with children still inside. That probe covers approximately 174,000 Model Y vehicles (Reuters).
NHTSA's initial review found that the manual door handles on Tesla vehicles may not function if the electronic door locks do not receive sufficient voltage from the vehicle's battery system. Tesla vehicles have manual door releases located only inside the car, which narrows the pathways for egress when the primary electronic system fails (TechCrunch).
The problem has attracted scrutiny beyond NHTSA's investigations. In January 2026, Congresswoman Robin Kelly of Illinois introduced federal legislation aimed at establishing vehicle door safety guidelines, explicitly naming Tesla's door handles in the bill (AutoEvolution). In March 2026, a proposed class action lawsuit was filed alleging a safety defect in the door handles of certain 2023-2026 Tesla Model S vehicles (Yahoo Autos).
Automakers, for their part, have signaled awareness of the issue. Tesla designer Franz von Holzhausen said in 2025 that the company was working on a redesign of its door handles. Rivian, separately, said in 2025 that it was changing the interior door handle design on its R2 SUV to place the manual release in a more visible location, closer to the electrically powered door handles (TechCrunch).
The tension at the center of this story is straightforward to identify even if it resists simple resolution. Flush, electronically actuated door handles serve clear design and aerodynamic objectives, but they introduce a dependency on vehicle electrical architecture for a function that, in an emergency, must work without fail. When the manual backup release is itself constrained by battery voltage or tucked out of immediate sight, the safety margin narrows in exactly the scenarios where it matters most. NHTSA's decision to pursue rulemaking rather than a defect investigation suggests the agency views this as a systemic design question across the industry, not a problem isolated to one manufacturer's implementation.
The scope of any eventual rule remains unknown. NHTSA was explicit that initiating the process carries no guarantee of a final regulation. The rulemaking will unfold over a timeline the agency has not yet detailed, and the docket will likely draw input from automakers, safety advocates, and consumers on where the line between design freedom and egress safety should sit. For an industry in the middle of a broad transition away from mechanical linkages toward electronic controls, the outcome of this process could establish a precedent that extends well beyond door handles.
