Former EPA Veterans Warn Faster AI Data Center Permits Raise Health Risks

Former EPA officials say the Trump administration is loosening environmental rules to speed AI data center construction, increasing health risks for nearby communities.
The warning came in a briefing and report covered Sept. 12. The sources are career EPA veterans now working as the Environmental Protection Network, an independent group of former EPA staff. They argue federal policy is trading pollution controls for faster buildout while U.S. data center power demand is driving new gas-fired generation and on-site power The Verge.
Thirty actions cataloged
The core document is "The Hidden Health Costs of AI Data Centers." It lists 30 federal actions since January 2025 that the authors say increase health risks from data center pollution The Verge.
Of the 30, 17 mention AI directly or target data centers. The rest apply more broadly to power generation, industrial air permits, and water and waste rules. The report includes them because new data centers depend on that power and infrastructure.
The cited policy anchor is the "AI Action Plan" released in July 2025. It recommended streamlining or cutting rules under the Clean Air Act, the Clean Water Act and Superfund law, the federal cleanup program for contaminated sites. EPA Administrator Lee Zeldin has said the goal is to make America "the AI capital of the world" through deregulation.
Former EPA assistant administrator Lynn Goldman, a pediatrician, said at the briefing that EPA is putting industry needs first and weakening or reconsidering limits on toxic chemicals and harmful pollutants. The group urges President Donald Trump to adopt a "Data Center Health Protection Pledge." That wording echoes the White House "Ratepayer Protection Pledge," which EPA describes as protecting communities that host data centers from utility price increases.
Permitting and disclosure changes
State and local air agencies issue most air permits for data centers. The report follows a series of federal steps to shorten that process. In September 2025, the Trump EPA moved to speed permitting for AI infrastructure under the Clean Air Act. On May 11, 2026, EPA proposed redefining "Begin Actual Construction," the legal point when building is considered started, to let work begin on non-polluting parts of power, data center and factory projects. On July 1, 2026, EPA proposed simplifying state and local permits for minor sources, meaning smaller polluters. On July 27, 2026, EPA issued permitting guidance to advance President Trump's data center agenda and protect communities.
Two changes affect public tracking and legal coverage. A proposed EPA rule would end required public notice and comment for minor New Source Review permits, the preconstruction air permits for smaller industrial sources. Separately, EPA has said power plants that serve only data centers and not the public grid may fall outside federal pollution laws Reuters. The administration has also proposed ending the requirement for data centers to publicly report air pollution.

Permitting steps such as preconstruction review, state minor-source permits and public comment add time to data center and power projects. Removing or narrowing them shortens the time to power. It also removes shared records. Public notice, emissions reporting and consistent rules create a common set of facts about what a site releases.
In my view, that shared record matters more for AI infrastructure because the footprint is wider than one building. A data center includes its backup generators and cooling systems, plus the off-site or dedicated power bought to run it, the water used for cooling, and the manufacturing and waste chain behind it. If dedicated power is treated differently from grid power, and small permits move ahead without notice and comment, nearby communities get less early warning while developers get more schedule certainty.
The broader context here is that technology buildouts have gone better when measurement kept pace with deployment. Continuous emissions monitoring, standard reporting and enforceable limits did not stop the cloud buildout. They made its effects visible and manageable.
Efficient cooling, cleaner firm power, shifting workloads in time, and siting away from vulnerable groups still shape local impact. A health pledge would not by itself change permit terms. In my view, its use will come down to whether monitoring, public disclosure and enforceable limits are restored around the facilities now being fast-tracked, which would leave room to build quickly while keeping effects visible.
