Law & Order: SVU will open its 28th season with a sexual assault case tied to consent and intoxication.

The episode, titled "Volition", is scheduled for Oct. 8 at 9 p.m. ET on NBC, according to Variety. It centres on a young woman in New York who says she was raped by multiple boys. Capt. Olivia Benson, played by Mariska Hargitay, pursues what NBC describes as a controversial strategy when the victim struggles to prove her case.

That choice strains a key working relationship. A meeting with a jury consultant threatens Benson's partnership with prosecutor Dominick Carisi, played by Peter Scanavino, under the official description.

The story draws on a real case in New York. The name Cornell 7 refers to seven male Cornell University students accused of drugging and gang-raping a female classmate in October 2024. No arrests had been made at the time of Variety's Oct. 6 report.

The legal question is specific. As written, New York rape law does not expressly protect voluntarily intoxicated victims. In May, the New York State Legislature attempted to amend the law. Hargitay has said a voluntary intoxication loophole exists in 19 states.

Showrunner Michele Fazekas wrote the premiere in July. It was also filmed in July. Hargitay has condemned the Cornell 7 allegations on Instagram and called for justice. She also advocates for assault victims through her Joyful Heart Foundation.

The SVU hour leads into Law & Order at 10 p.m. ET. The Season 26 premiere of the original series turns to AI autonomy, after a software engineer's murder sends Detectives Riley and Walker into the world of AI. Reid Scott plays Riley and David Ajala plays Walker, with Rick Eid as showrunner.

Both episodes will be available to stream the next day on Peacock.

For viewers, this is a busy stretch for SVU. The series was renewed for Season 28 for the 2026-27 season, as reported by Deadline. J. Smith-Cameron joins in a recurring role starting with the premiere. The show will pass 600 episodes later in 2026, with episode 600 scheduled for Nov. 12, and New York Knicks player Jalen Brunson is set to guest star.
